{"id":3,"date":"2021-03-21T02:46:43","date_gmt":"2021-03-21T02:46:43","guid":{"rendered":"https:\/\/carformerentals.com\/?page_id=3"},"modified":"2025-04-02T23:21:08","modified_gmt":"2025-04-02T22:21:08","slug":"terms-conditions","status":"publish","type":"page","link":"https:\/\/carformerentals.com\/sr\/terms-conditions\/","title":{"rendered":"Terms&#038;Conditions"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><div class=\"vc_row wpb_row vc_row-fluid pix-vc_row-no-padding pix-row-overlay\"><div class=\"wpb_column vc_column_container vc_col-sm-12\"><div class=\"vc_column-inner\" ><div class=\"wpb_wrapper\"><div class=\"vc_tta-container\" data-vc-action=\"collapse\"><div class=\"vc_general vc_tta vc_tta-tabs vc_tta-color-grey vc_tta-style-classic vc_tta-shape-rounded vc_tta-spacing-1 vc_tta-tabs-position-top vc_tta-controls-align-left\"><div class=\"vc_tta-tabs-container\"><ul class=\"vc_tta-tabs-list\"><li class=\"vc_tta-tab vc_active\" data-vc-tab><a href=\"#1655604761021-bcefe4fd-4738\" data-vc-tabs data-vc-container=\".vc_tta\"><span class=\"vc_tta-title-text\">English<\/span><\/a><\/li><li class=\"vc_tta-tab\" data-vc-tab><a href=\"#1655604761056-acacdb5c-3377\" data-vc-tabs data-vc-container=\".vc_tta\"><span class=\"vc_tta-title-text\">srpski<\/span><\/a><\/li><\/ul><\/div><div class=\"vc_tta-panels-container\"><div class=\"vc_tta-panels\"><div class=\"vc_tta-panel vc_active\" id=\"1655604761021-bcefe4fd-4738\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title\"><a href=\"#1655604761021-bcefe4fd-4738\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">English<\/span><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<h2>\u00a0<\/h2>\n<h2 style=\"text-align: center;\">CAR RENTAL CONTRACT TERMS AND CONDITIONS<\/h2>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\">Concluded by and between <strong>CARFORME d.o.o. <\/strong>(further referred to as CARFORME) and <strong>car user<\/strong> (further referred to as <strong>User<\/strong>)<\/p>\n<p style=\"text-align: left;\"><strong>Article 1.<\/strong> CARFORME rents to User a vehicle under the Terms and Conditions set forth by this Contract, the applicable price list, our Rental Information and the Instructions for User in case of traffic accident and other regulations.<\/p>\n<p style=\"text-align: left;\"><strong>Article 2.<\/strong> By signing this Contract User agrees to the Contract and price list and is obliged to the following: a) that he\/she took over the rented vehicle in accordance with the Road Traffic Safety Law. b) that he\/she received vehicle documents, keys to the vehicle, all obligatory equipment and accessories as well as additional equipment and accessories listed in the contract along with the vehicle c) that he\/she shall return the rented vehicle after the expiry of rental period to the location and within the term defined in this Contract, or before the expiry of rental period, immediately on CARFORME&#8217;s request. d) that he\/she shall cease driving immediately in case there is a malfunction of mileage recorder and inform CARFORME without delay. e) that he\/she will not use the rented vehicle for illegal purposes (perpetrating criminal deeds, offence against customs and exchange regulations as well as other forbidden acts), driver training, renting to third persons, freight or haul of other vehicles or trailers, participating in auto-sports events, under the influence of alcohol, drugs or other narcotics. In case User acts are contrary to this point he\/she shall be obliged to indemnify CARFORME without delay for the incurred damage in full amount. f) that he\/she shall use the vehicle for their own purposes only and the vehicle shall be driven by User or a person fulfilling terms of the Contract. Material liability of these persons is joint. g) that he\/she shall not overload the vehicle with persons and objects nor cross state borders without previously obtained international motor insurance card from CARFORME. In case User crosses state border without previously obtaining international motor insurance card he\/she shall be obliged to bear all material liability towards CARFORME and competent authorities of the state he happens to be in with the rented vehicle for the subject offence. h) that he\/she must not perform any replacement of parts, assemblies, device, equipment or to change in any way the outside appearance of the vehicle without written consent of CARFORME. User is obliged to reimburse CARFORME for replaced or missing parts to the extent of their market value latest on the day of returning the vehicle. i) that he\/she necessarily uses available device or means for seeming vehicle against theft and protect the vehicle. j) that he\/she shall at any time enable control of vehicle and documentation by a person authorized by CARFORME k) that he\/she shall use<br \/>the vehicle with due care.<\/p>\n<p style=\"text-align: left;\"><strong>Article 3.<\/strong> User is obliged to meet basic conditions for vehicle rental at that: possession of a valid driving license, obligatory identification by presenting identity card or passport, proof of capacity of User within legal entity (employment contract, authorization, company seal etc.) obligatory payment card as means of security and payment, advance payment of calculated rental days. Minimum length of rental is one day (24 hours), whereby delay of up to 60 minutes in returning the vehicle shall be tolerated after which another rental day shall be automatically calculated in accordance with valid price list. Maximum length of rental is 12 months, however CARFORME reserves the right to decide on the length of vehicle rental by User.<\/p>\n<p style=\"text-align: left;\"><strong>Article 4.<\/strong> When concluding the Contract User is obliged to make a down payment of defined amount and deposit all documents stated in Article 3 of this Contract.<\/p>\n<p style=\"text-align: left;\"><strong>Article 5.<\/strong> User accepts to pay to CARFORME: a) vehicle rental and other services according to valid price list For the amount of paid downpayment rental price is guaranteed to the extent of downpayment amount. b) costs for fuel, puncture repair and fees (road tolls, bridge tolls, ferryboat fee, fines, tickets, charges and court disputes) shall be borne by User. In case those fees are previously settled by CARFORME they shall be reimbursed by User, c) return mileage in case User returns rented vehicle to location different from the location originally agreed for returning the vehicle.<\/p>\n<p style=\"text-align: left;\"><strong>Article 6.<\/strong> The User shall be provided for usage a technically sound vehicle. For all potential technical defects that occur during the rental period the User shall be fully liable. If during vehicle usage there occurs the following defect of: engine, drive mechanism, gearshift, clutch, crankcase or other characteristic part (in case of lack of oil for engine, differential, gearshift, cooling fluid, engine overheat etc.) contractual parties shall mutually, in an official service remove defects and determine the amount of the incurred material damage. In case the defect was incurred due to negligence of User, User shall be obliged to reimburse CARFORME for the inflicted material damage to the vehicle in full amount and lost profit due to non-usage of the vehicle in the<br \/>amount of minimum profit of CARFORME in accordance with valid price list, for 30 days at the most. In case of total damage User is obliged to indemnify CARFORME for the full loss of profit from the day when total damage occurred till the day of replacement of damaged vehicle by a new one.<\/p>\n<p style=\"text-align: left;\"><strong>Article 7.<\/strong> In case of traffic accident, damage, theft of vehicle or parts or defect of vehicle driven, User is obliged not to leave the vehicle before he\/she ensures handover of vehicle to CARFORME, waited for the police to come and make a record, and completes correctly and fully the\u201cEuropean report for traffic accidents\u201d, except in case of defect of vehicle driven and submitted written statement to the nearest office of CARFORME. In case User fails to perform any of the above mentioned actions and by that inflicts damage to CARFORME he\/she is obliged to reimburse for the inflicted damage in full amount.<\/p>\n<p style=\"text-align: left;\"><strong>Article 8.<\/strong> By putting his\/her signature the User confirms he\/she is acquainted with the feet that rental price includes insurance for the driver and all persons, obligatory third party insurance and, if purchased insurance against theft and Fully Comprehensive Car Insurance Cover (\u201cCASCO insurance&#8221;) with the applicable Non Waiver Responsibility (\u201cNWR\u201d) as described within the Rental Agreement and Rental Information. Insurances does not cover damage that occurs: inside the vehicle; to the underside, tyres or wheels of the vehicle; for broken or lost key; damage caused by filling up inadequate type of fuel; and\/or damage caused on purpose or by negligence. All the above mentioned damages shall be charged in full amount to the User at the latest at the time of returning the vehicle.<\/p>\n<p style=\"text-align: left;\"><strong>Article 9.<\/strong> CARFORME shall not be liable for damage inflicted to third parties caused by improper driving of vehicle User, for damage inflicted by loss or damage of luggage or goods located in or on the vehicle.<\/p>\n<p style=\"text-align: left;\"><strong>Article 10.<\/strong> User shall be obliged to return the vehicle within the agreed period to the agreed location. In case of a necessity for extension of rental period there shall be signed a new contract after User settles all outstanding liabilities as per previously concluded contract.<\/p>\n<p style=\"text-align: left;\"><strong>Article 11.<\/strong> In case of dispute arising out of this Contract, contractual parties shall try to settle the dispute by an extrajudicial agreement or otherwise acknowledge the jurisdiction of court in Podgorica.<\/p>\n<p style=\"text-align: left;\"><strong>Article 12.<\/strong> All other issues that are not envisaged by this Contract shall be regulated in accordance with Contract Law of the Republic of Montenegro.<\/p>\n<p style=\"text-align: left;\"><strong>Article 13.<\/strong> Instruction for user in case of traffic accident forms an integral part to this Contract and by signing this Contract User confirms to be acquainted with its content. This Contract is made in 2 identical copies,1 for CARFORME and 1 for User.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\">Instructions for User in case of traffic accident<\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><strong><span style=\"color: #ff0000;\">POLICE RECORDS OBLIGATORY FOR<\/span> <span style=\"color: #ff0000;\">ALL KINDS OF INSURANCE!<\/span><\/strong> In case vehicle User does not ensure police presence or police record and complete correctly and fully the \u201cEuropean report for traffic accidents\u201d the full amount for the damage and\/or theft shall be charged to User irrespective of the type of purchased insurance. It is necessary to make a police<br \/>record and complete correctly and fully the \u201cEuropean report for traffic accidents\u201d even in case when User was not present at the moment the car damage was inflicted (eg. vehicle was damaged on the parking lot by an unknown perpetrator)<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><strong>ACTIONS in case of traffic accident, damage and theft<\/strong><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\">the User is obliged to act in the following manner: <strong>IMMEDIATELY<\/strong> inform the police and CARFORME about the event and act according to their instructions. User shall not be allowed to operate the vehicle under the influence of alcohol, medications and drugs, without a passed driving test for that category of vehicle, or without international motor insurance card in case of operating vehicle abroad. In these cases, insurance <strong>IS NOT VALID<\/strong> and client is charged with foil amount of damage\/theft. User shall not be allowed to give the rented vehicle for usage to unauthorized persons i.e. persons that are not listed in the Contract on car rental. In these cases insurance <strong>IS NOT VALID<\/strong> for User and he\/she shall be charged with full amount of damage.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1655604761056-acacdb5c-3377\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title\"><a href=\"#1655604761056-acacdb5c-3377\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">srpski<\/span><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<h2 class=\"wp-block-heading\">\u00a0<\/h2>\n<h2 style=\"text-align: center;\">ODREDBE I USLOVI UGOVORA O NAJMU<\/h2>\n<p>&nbsp;<\/p>\n<p>Zaklju\u010deni izme\u0111u <strong>CARFORme d.o.o.<\/strong> (u daljem tekstu <strong>CARFORme<\/strong> ) i <strong>korisnika<\/strong> vozila (u daljem tekstu<strong> korisnik<\/strong>).<\/p>\n<p><strong>\u010clan 1.<\/strong> CARFORme daje korisniku na kori\u0161\u0107enje vozilo pod Odredbama i Uslovima utvr\u0111enim ovim Ugovorom, primjenljivim cjenovnikom, na\u0161im Informacijama o najmu i Uputstvom o postupanju korisnika u slu\u010daju saobra\u0107ajne nezgode i ostalim pravilima.<\/p>\n<p><strong>\u010clan 2.<\/strong> Korisnik se svojim potpisom saglasio sa ovim Ugovorom i cjenovnikom i obavezuje se : a) da je iznajmljeno vozilo preuzeo shodno zakonu o osnovama bezbjednosti saobra\u0107aja na putevima, b) da je uz vozilo primio dokumenta za vozilo, klju\u010deve za vozilo, svu obaveznu opremu i pribor, kao i dodatnu opremu i pribor naveden u ugovoru, c) da iznajmljeno vozilo nakon zavr\u0161enog najma vrati na mjesto i u roku utvr\u0111enom ovim Ugovorom, odnosno prije isteka najma, odmah na zahjtev CARFORme d) da odmah prekine vo\u017enju ako se za vrijeme najma dogodi kvar i odmah obavijesti CARFORme e) da iznajmljeno vozilo ne\u0107e koristiti u nedozvoljene svrhe (za vr\u0161enje krivi\u010dnih dijela, carinskih, deviznih i drugih prekr\u0161aja, kao i drugih nedozvoljenih radnji) za obuku voza\u010da, za rentiranje tre\u0107im licima, prevoz tereta ili vu\u010du drugih vozila ili prikolica i za sudjelovanje u auto sportskim priredbama, niti pod dejstvom alkohola, droga ili drugih opojnih sredstava. Ukoliko korisnik postupi suprotno ovoj ta\u010dki, nadoknadi\u0107e bez odlaganja CARFORme-u pri\u010dinjenu \u0161tetu u punom iznosu, f) da \u0107e iznajmljeno vozilo koristiti samo za sopstvene potrebe i vozilom upravljati korisnik ili lice koje ispunjava sve uslove i navedeno je u Ugovoru. Materijalna odgovomost ovih lica je solidarna, g) da iznajmljeno vozilo ne optereti osobama ili predmetima preko dozvoljene maksimalne te\u017eine niti da vozilom pre\u0111e dr\u017eavnu granicu bez prethodno pribavljenog zelenog kartona i pe\u010data za dozvoljen prelazak granice od strane CARFORme. U koliko korisnik pre\u0111e dr\u017eavnu granicu bez prethodno dobijenog zelenog kartona i pe\u010data za dozvoljen prelazak granice, u obavezi je da snosi svu materijalnu odgovornost prema CARFORme -u i nadle\u017enim organima dr\u017eave u kojoj se zatekao sa iznajmljenim vozilom za predmetni prekr\u0161aj, h) da bez pismene saglasnosti CARFORme -a ne smije vr\u0161iti nikakvu promjenu djelova, sklopova, ure\u0111aja, opreme ili da mijenja na bilo koji na\u010din spolja\u0161nji izgled vozila. Promijenjene ili nedostaju\u0107e djelove korisnik je du\u017ean nadoknaditi CARFORme-u u visini njihove tr\u017ei\u0161ne vrijednosti najkasnije na dan vra\u0107anja vozila, i) da ure\u0111aje ili sredstva za obezbje\u0111ivanje vozila od kra\u0111e koja su na raspolaganju obavezno koristi i vozilo za\u0161titi, j) da u svako doba omogu\u0107i kontrolu vozila i dokumentacije ovla\u0161\u0107enom iicu CARFORme -a. k) da vozilo upotrebljava kao dobar doma\u0107in.<\/p>\n<p><strong>\u010clan 3.<\/strong> Korisnik je u obavezi da ispuni osnovne uslove za najam vozila i to: posjedovanje va\u017ee\u0107e voza\u010dke dozvole, obavezna identifikacija sa li\u010dnom kartom ili paso\u0161em, dokaz o svojstvu korisnika u pravnom licu (ugovor o radu, punomo\u0107je, pe\u010dat firme i sli\u010dno) obavezna platna kartica kao sredstvo obezbje\u0111enja i pla\u0107anja, avansno pla\u0107anje sabranih dana najma. Minimalna du\u017eina najma je 1 dan (24h), tolerisa\u0107e se 60 minuta zaka\u0161njenja vra\u0107anja vozila, a potom automatski zara\u010dunavati novi dan najma prema va\u017ee\u0107em cjenovniku. Maksimalna du\u017eina najma je 12 meseci, s tim \u0161to CARFORme zadr\u017eava diskreciono pravo odlu\u010divanja o du\u017eini najma korisnika vozila.<\/p>\n<p><strong>\u010clan 4.<\/strong> Korisnik je du\u017ean da pri zaklju\u010divanju ugovora akontira utvr\u0111eni nov\u010dani iznos i deponuje sva dokumenta i akta iz \u010dlana 3 ovog ugovora.<\/p>\n<p><strong>\u010clan 5.<\/strong> Korisnik prihvata da isplati CARFORme -u: a) najam vozila i ostale usluge prema va\u017ee\u0107em cjenovniku. Za iznos upla\u0107ene akontacije garantuje se cijena najma do visine akontacije, b) tro\u0161kove goriva, opravke auto guma i naknada (drumarine, mostarine, trajekta, kazni, parking kazni, taksa i sudskih sporova) padaju na teret korisnika. Ukoliko ih je CARFORme\u00a0 prethodno platio, refundira\u0107e ih od korisnika, c) povratnu kilometra\u017eu kad korisnik vra\u0107a iznajmljeno vozilo van ugovorenog mjesta vra\u0107anja voziia.<\/p>\n<p><strong>\u010clan 6.<\/strong> Korisniku se na kori\u0161\u0107enje daje tehni\u010dki ispravno vozilo, a za sve eventualne tehni\u010dke neispravnosti koje nastanu u toku najma korisnik snosi punu odgovornost. Ako prilikom kori\u0161\u0107enja vozila do\u0111e do o\u0161te\u0107enja motora, pogonskog mehanizma, mjenja\u010da, kva\u010dila, kartera ili drugog karakteristi\u010dnog dijela (usled nedostatka ulja motor, diferencijal, menja\u010d, sredstva za hla\u0111enje, pregrijanost motora i sl.) ugovorene strane \u0107e zajedni\u010dki, u ovla\u0161\u0107enom servisu, izvr\u0161iti defekta\u017eu kvara, i utvrditi visinu materijalne \u0161tete. Ukoliko je do kvara do\u0161lo usled nepa\u017enje korisnika, korisnik je du\u017ean da nadoknadi CARFORme -u pri\u010dinjenu materijalnu \u0161tetu na vozilu u punom iznosu i izgubljenu dobit zbog nekori\u0161\u0107enja vozila u visini minimalne zarade CARFORme -a prema va\u017ee\u0107em cjenovniku, a najvi\u0161e 30 dana. U slu\u010daju totalne havarije korisnik je du\u017ean da CARFORme -u nadoknadi izgubljenu dobit od dana havarije do dana zamjene havarisanog vozila novim.<\/p>\n<p><strong>\u010clan 7.<\/strong> U slu\u010daju saobra\u0107ajnog udesa, havarije, kra\u0111e vozila ili djelova ili pogonske neispravnosti vozila korisnik je du\u017ean da ne napu\u0161ta vozilo dok ga nije obezbjedio za preuzimanje od strane CARFORme -a, da sa\u010deka organe MUP-a i obezbijdi njihov zapisnik, i da pravilno popuni \u201cEvropski izve\u0161taj o saobra\u0107ajnoj nezgodi\u201d, sem u slu\u010daju pogonske neispravnosti vozila i podnese pismenu izjavu najbli\u017eoj poslovnici CARFORME-a. Ukoliko korisnik propusti neke od navedenih radnji i time pri\u010dini \u0161tetu CARFORME-u, du\u017ean je da pri\u010dinjenu \u0161tetu nadoknadi u punom iznosu.<\/p>\n<p><strong>\u010clan 8.<\/strong> Korisnik svojim potpisom potvr\u0111uje da je upoznat da cijna najma uklju\u010duje osiguranje voza\u010da i lica, obavezno osiguranje, ako je kupljeno osiguranje od kra\u0111e i osiguranje od \u0161tete sa odgovaraju\u0107im u\u010de\u0161\u0107em u kra\u0111i\/\u0161teti, kako stoji u Ugovoru o najmu i Informacijama o najmu. Osiguranje ne pokriva slede\u0107e: \u0161tete nastale u unutra\u0161njosti vozila; \u0161tete nastale na \u0161asiji vozila sa donje strane; o\u0161te\u0107enje guma i to\u010dkova; slomljen i \/ ili izgubljen klju\u010d; \u0161tete nastale tankanjem pogre\u0161ne vrste goriva; \u0161tete nastale svjesno (vo\u017enja van regularnih puteva) ili nepa\u017enjom korisnika. Sva nabrojana o\u0161te\u0107enja bi\u0107e napla\u0107ena u punom iznosu od korisnika najkasnije u momentu vra\u0107anja vozila.<\/p>\n<p><strong>\u010clan 9.<\/strong> CARFORME ne odgovara za \u0161tetu pri\u010dinjenu tre\u0107im licima nastalu nepropisnom vo\u017enjom korisnika vozila, za \u0161tetu nastalu gubitkom ili o\u0161te\u0107enjem prtljaga i robe koja se nalazila u ili na vozilu.<\/p>\n<p><strong>\u010clan 10<\/strong>. Korisnik je du\u017ean da vozilo vrati u ugovorenom roku na ugovorenom mjestu. U slu\u010daju potrebe za produ\u017eenjem najma potpisa\u0107e se novi ugovor po\u0161to korisnik izmiri sve obaveze po prethodno zaklju\u010denom ugovoru.<\/p>\n<p><strong>\u010clan 11.<\/strong> U slu\u010daju spora po ovom ugovoru, strane ugovornice \u0107e poku\u0161ati da spor rij\u0161e vansudskim sporazumom, u suprotnom priznaju nadle\u017enost suda u Podgorici.<\/p>\n<p><strong>\u010clan 12.<\/strong> Za sve \u0161to nije predvi\u0111eno ovim ugovorom primjenjiva\u0107e se Zakon o obligacionim odnosima Republike Crne Gore.<\/p>\n<p><strong>\u010clan 13<\/strong>. Uputstvo o postupanju korisnika za slu\u010daj saobra\u0107ajne nezgode predstavlja sastavni dio ovog ugovora i korisnik svojim potpisom potvr\u0111uje da je upoznat sa sadr\u017eajem istog. Ovaj ugovor je sa\u010dinjen u 2 istovjetna primerka, 1 za CARFORME i 1 za korisnika.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><strong>Uputstvo za postupanje korisnika u slu\u010daju saobra\u0107ajne nezgode<\/strong><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>POLICIJSKI ZAPISNICI SU OBAVEZNI ZA SVE VRSTE OSIGURANJA!<\/strong><\/span> U koliko korisnik vozila ne obezbijedi prisustvo policije odnosno policijski zapisnik i pravilno popunjen \u201cEvropski izvje\u0161taj o saobra\u0107ajnoj nezgodi\u201d pun iznos \u0161tete i \/ili kra\u0111e bi\u0107e napla\u0107en od korisnika, bez obzira na vrstu kupljenog osiguranja.
